Insurance Delays

We (the Law Office of David A. Carroll) are having tremendous success obtaining excellent settlements for our hurricane clients. We go the extra mile and it makes a difference in getting substantial results. Recently I went out to meet a structural engineer at our clients’ property. Our client was out of town and would require a three-week delay for them to meet with the engineer, so I went in their place.

When insurance companies require multiple appraisals it can cause long delays. This seems to me to be one of the ways insurance company’s get property owners to settle for less than they deserve.

On this morning I went to our client’s home on Mexico Beach. The home was completely destroyed. Only the slab remained. However, the Insurance company still found it necessary to require an engineering report.

There is nothing left.

We are trying to resolve this case for our client without litigation. However, the company has not accepted our assessment. They have already had their own adjuster complete a report, but they continue to require additional evaluations. Now, four months into the process, they have insisted on a structural engineer inspection to determine whether or not the house was washed away by storm surge or if wind blew it away.

I was given a time to meet at the property; between 7 o’clock and 7:30 a.m. My client lives out of state and could not be here. So as the lawyer, I arrived at the property at 6:40 AM to make sure I don’t miss the structural engineer. At 7:40 AM, there was still no sign of the engineer.

The engineer finally arrived about 9:00 a.m.

Why the delay? I believe some insurance companies place unnecessary road blocks and speed bumps to push homeowners to settle. Obviously, our clients are very anxious to get back in their homes, and they are feeling this pressure.
